accessing, browsing, creating an account, or purchasing from Softwoods, you agree to be bound by the terms and
conditions outlined below, along with all applicable Australian Federal and State legislation.
- GENERAL CONDITIONS & ONLINE STORE USAGE
This web store is operated by Softwoods. Throughout the site, the terms "we", "us", and "our" refer to Softwoods. By
visiting our store and/or purchasing products or trade items from us, you engage in our "Service" and agree to be bound
by these Terms of Service ("Terms").
By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence,
or that you have given us consent to allow any of your minor dependents to use this site. You may not use our products
for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction
(including but not limited to copyright and trade licensing laws).
- PRODUCTS, TIMBER SPECIFICATIONS & NATURAL VARIATIONS
Softwoods specialises in timber, hardware, outdoor structural kits (pergolas, decking, verandas), and trade construction
materials. Customers must acknowledge the inherent natural characteristics of timber products:
Natural Material Variation: Timber is a natural organic product. Variations in color, grain, texture, surface checking,
naturally occurring knots, and slight dimensional tolerances are inherent characteristics and are not considered
manufacturing defects.
Site & Environmental Factors: Timber expands and contracts in response to ambient atmospheric moisture and
climate conditions. Softwoods is not liable for movement, warping, or weathering resulting from improper site storage
or exposure prior to seal coating and installation.
Structural & Building Codes: It is the buyer’s responsibility to ensure that products ordered meet localized
structural requirements, council regulations, and Australian Building Codes (including engineering span tables) for
their specific project site.
- PRICING, TRADE ACCOUNTS & ONLINE ORDERING
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue
any Product or Service without notice.
Price Display: Unless specified otherwise, all prices displayed on the Shopify store are listed in Australian Dollars
(AUD) and are inclusive of Goods and Services Tax (GST).
Trade & B2B Customers: Trade accounts, customized pricing tiers, or bulk commercial quotes integrated into the
web store require prior approval. We reserve the right to audit, adjust, or cancel orders placed under mismatched or
unauthorized trade pricing tiers. Order Acceptance & Quantity Errors: We reserve the right to refuse any order placed with us. In the event that an item is listed at an incorrect price or quantity due to a system indexing error, we retain the right to cancel or adjust the order after notification.
- DELIVERY, FREIGHT & SITE ACCESS REQUIREMENTS
Softwoods delivers across designated regional and metropolitan operational zones. Delivery services are subject to
strict site conditions: Delivery Point (Kerbside Only): Deliveries are standard kerbside drops. Drivers will place goods at the nearest safe and accessible location at the front of the property. Offloading beyond the property boundary (e.g., inside backyards or building sites) is at the driver's sole discretion based on safety and site access. Site Accessibility: It is the customer's responsibility to notify Softwoods of restricted access (narrow lanes, steep driveways, unpaved roads, or overhead obstructions). If delivery cannot be completed safely, re-delivery fees will apply.
Unattended Deliveries: If you request goods to be left unattended on site ("Authority to Leave"), risk passes to the
buyer upon offloading. Softwoods accepts no liability for theft, loss, or weather damage occurring post-delivery.
- CLICK & COLLECT (IN-STORE PICKUP)
Orders designated for Click & Collect are available from designated Softwoods retail yards or dispatch facilities during
business hours:
Collection dates and times will be confirmed via automated email or SMS notification. Do not attempt pickup prior to
receiving collection confirmation.
Appropriate vehicles, trailers, or restraints compliant with state transport safety regulations must be provided by the
customer. Softwoods staff reserve the right to refuse loading onto unroadworthy or unsafe transport configurations.
- RETURNS, REFUNDS & CONSUMER GUARANTEES
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are
entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or
damage.
Change of Mind Returns: Change of mind returns are accepted at Softwoods' discretion within 14 days of receipt,
provided items are unused, undamaged, and in original salable condition. Restocking fees (up to 15%) and return
freight costs apply.
Custom-Cut, Special Orders & Manufactured Trusses: Made-to-order items, custom-machined timber profiles,
pre-assembled frame units, or specially ordered hardware cannot be returned or refunded for change of mind.
Damaged or Incorrect Goods: Discrepancies, shortages, or damaged timber must be reported to Softwoods within
48 hours of delivery accompanied by photographic evidence.
Pro-Tip for Job Sites: Always inspect timber packs immediately upon delivery. Cover timber stored on-site with breathable
waterproof tarps, elevated off the ground on gluts, to protect against weather distortion prior to installation.
- INTELLECTUAL PROPERTY & STORE CONTENT
All content included on or comprising this store, including information, data, software, photographs, graphs, videos,
typefaces, graphics, music, sounds, design guides, structural calculators, and other material are protected by copyrights,
trademarks, or other proprietary rights owned by Softwoods.
- LIMITATION OF LIABILITY
To the maximum extent permitted by law, Softwoods shall not be liable for any indirect, incidental, special,
consequential, or punitive damages, including loss of profits, revenue, data, or building project delay costs arising out of
or in connection with the purchase, delivery, or use of products from this store.
